  1. Licenses of use.

The User guarantees 3INA Cosmetics, SL, (hereinafter 3INA) that they are the sole and exclusive owner of the rights inherent to the Content, or that they have the necessary authorization and permissions from the legitimate owners of said rights. The User assigns to 3INA, free of charge, for Spain and the rest of the world, perpetually from the reception of an email with #apruebo, the exploitation rights (rights of reproduction, distribution, use, and public communication) over the Photographs, for their publication on social networks, website, and newsletter. Likewise, the User grants 3INA an exclusive, irrevocable, worldwide, indefinite, free, and transferable license to use their Instagram username.

  1. User responsibility.

The User is solely responsible for the Photographs they send, and declares and guarantees that they comply with all applicable laws, rules, and regulations, as well as Instagram's Terms of Use (https://www.instagram.com/legal/terms).

. In this regard, for the purposes of these Conditions, any Photograph that, by way of example, but not limitation, is expressly prohibited if it:

  • Infringes any applicable local, national, or international law or regulation.
  • Infringes the legitimate rights of any person.
  • Infringes any image right, intellectual property, industrial property, or other proprietary rights.
  • Violates the right to personal privacy and the privacy of any person.
  • Is defamatory or constitutes slander, threat, or coercion.
  • Is false, inaccurate, or misleading.
  • Is obscene, contains child pornography, or is racially, ethnically, or otherwise objectionable (at our sole discretion).
  • Aims to impersonate any person.
  • Contains extraneous elements that may cause alterations to the Users' and/or 3INA's computer equipment and applications. By way of example, "computer viruses," "Trojan horses," errors in functionality and operability ("bugs"), "time bombs," "cancelbots."
  • Constitutes advertising of any kind for products and services unrelated to 3INA.
  1. Indemnification.

You agree to hold harmless and indemnify 3INA against any claim arising from or related to your breach or alleged breach of any of these Terms and Conditions of use or applicable laws.

  1. Jurisdiction and applicable law.

These Terms and Conditions shall be governed by Spanish law. Any claim, legal proceeding, or litigation arising in connection therewith shall be subject solely to the jurisdiction of the courts of Madrid.

Data Recipients: YOTPO (Data Processors). Data is not transferred to third parties, except as legally required.

Rights: Access, rectify, erase, object, restrict processing, not be subject to automated decisions, and data portability.
