Legal Terms and Conditions for the 3INA Spain TIK-TOK Giveaway

CLAUSE 1 - ORGANIZING COMPANY.

3INA Cosmetics, SL, with registered office at c/ Serrano nº 2, Madrid, with CIF B-87141305 and owner of the 3INA brand, on the dates indicated below, will hold a free Raffle with no obligation to purchase (hereinafter "the Raffle") in accordance with the requirements described in these Terms and Conditions.

CLAUSE 2.- OBJECTIVE AND CONDITIONS OF THE RAFFLE.

The participation period is from November 25, 2022, to December 1, 2022, at 11:59 p.m., inclusive. Anyone wishing to participate must:

- Be over 16 years old, or failing that, act represented by or with the authorization of the holder of parental authority or guardianship over the child.

- Follow @3inaspain on TikTok

- Like the post.

- Comment on the raffle post, mentioning two friends (male/female/non-binary) with their profile. They must be different people each time and famous profiles must be excluded.

- Winners will only be contacted from the @3inaSpain profile.

The raffle is national in scope.

CLAUSE 3.- PRIZE.

1 prize will be awarded to 1 winner. The prize will consist of a 3INA makeup pack valued at €110.75 which includes:

The Every Single Day SPF 50

CLAUSE 4.- RAFFLE.

The Raffle will be held on December 2, 2022, at the 3INA Headquarters in Madrid, c/ Velázquez nº 53, by random drawing of 1 winner and 3 additional participants as reserves.

CLAUSE 5.- PRIZE DELIVERY.

The winner will be contacted by private message on TikTok or Instagram, only from the official @3INASpain profile.

If it is not possible to locate the winner within 2 days by private message on Instagram for them to accept the prize, or if they expressly reject the prize for any reason, the Raffle will be declared void.

Once the prize is accepted, the winner will receive a message via Instagram or TikTok with instructions for prize delivery. The prize will be sent to the address provided by the winner within a maximum of 30 business days after the resolution of the raffle.

The prize of this raffle will be subject to Law 35/2006 of November 28 on Personal Income Tax and Royal Decree 439/2007 of March 30, which approves the Personal Income Tax Regulations.

CLAUSE 6. INTELLECTUAL PROPERTY.

The winner authorizes their image and Instagram username to be published on the 3INA website and social networks, as well as in any of the brand's official communication channels, without this generating any right in their favor to receive any compensation.

CLAUSE 7 -. ACCEPTANCE OF THE TERMS AND CONDITIONS AND LIABILITY.

  1. The mere act of participating in the Raffle implies full acceptance of these Terms and Conditions and compliance with Instagram's conditions.
  2. It is expressly stated that Instagram does not sponsor, endorse, administer, or associate with this Raffle in any way.
  3. 3INA reserves the right to modify the Raffle Terms and Conditions, partially or totally, at any time. Likewise, it also reserves the right to cancel it or declare the prize void if any irregularity is detected. Any modification made will be duly communicated to the participants on the 3INA Website.
  4. 3INA reserves the right to exclude from participation in the Raffle all those participants who, it deems, are violating any condition of participation included in these Terms and Conditions. The exclusion of a participant, whatever the cause, entails the loss of all rights derived from their status as such.
  5. Any abusive or fraudulent use of these Terms and Conditions will result in the subsequent disqualification of the participant in the Raffle.
  6. 3INA is exempt from any responsibility in the event of any error in the data provided by the winners themselves that would prevent their identification.

CLAUSE 8 -. PRIVACY POLICY.

Controller: 3INA COSMETICS S.L, with registered office for notification purposes in Madrid, 28001, c/ Velázquez nº 53.

Purpose: The main purpose of processing personal data is the maintenance, fulfillment, development, and management of this raffle, contact with the winners and publication of their username on the 3INA Instagram account/profile as raffle winners, as well as the inclusion of their name and image on the 3INA website and social networks and in any of the brand's official communication channels, verification of compliance with the conditions to be a participant and winner; prize delivery; and, where applicable, compliance with tax obligations.

Legitimation: We process personal data based on consent by participating in the raffle.

Recipients: Data is not transferred to third parties, except for legal obligation.

Data retention period: information will be retained only until the end of the raffle and, if applicable, prize delivery.

Rights: You can exercise the rights of access, rectification, erasure, restriction of processing, data portability, and objection in the terms set forth in the General Data Protection Regulation and the Organic Law on Personal Data Protection. To do this, send an email to hello@3ina.com, or send a letter to IT Dept., Madrid, 28001, c/ Velázquez nº 53.

Any complaint about the processing of your data must be submitted to the Spanish Data Protection Agency C/ Jorge Juan, 6, 28001 Madrid (www.agpd.es).

CLAUSE 9. – APPLICABLE LAW - DISPUTES.

These Terms and Conditions are subject to Spanish law. Any claim related to the Raffle must be sent in writing to 3INA Cosmetics, SL, to the attention of the 3INA Marketing Department, at the following address: c/ Velázquez nº 53, 28001, Madrid, within thirty (30) days after the deadline for participation in the Raffle. In case of controversy in the application or interpretation of these Terms and Conditions and in the absence of an amicable agreement, any dispute will be subject to the courts of the city of Madrid.

SORTEO THE NO-RULES CLOUD

 

CLÁUSULA 1 - EMPRESA ORGANIZADORA.  

3INA Cosmetics, SL, con domicilio social en c/ Doctor Fourquet nº 3, Madrid, con CIF B-87141305 y propietaria de la marca 3INA, organiza en las fechas indicadas a continuación, un Sorteo gratuito, en España, sin obligación de compra (en adelante “el Sorteo”) de acuerdo con los requisitos que se describen en estas Bases. 

CLÁUSULA 2.- OBJETIVO Y CONDICIONES DEL SORTEO. 
El plazo de participación es desde el 14 de Septiembre de 2026 al 28 de Septiembre de 2026 a las 23:59, ambos inclusive. Quien desee participar deberá: 

- Ser mayor de 18 años. 
- Crearse una cuenta en 3INA Colour Club, el programa de fidelidad de 3INA. 

CLÁUSULA 3.- PREMIO. 
Se entregarán 2 premios a 2 ganadores. El premio consiste en 2 cajas, que contienen 4 tonos (503,565,254 y 362) The No-Rules Cloud. 

El valor de cada premio es de 50,85€.  

CLÁUSULA 4.- SORTEO. 
El Sorteo se realizará el 30 de Septiembre de 2026 en las oficinas Centrales de 3INA en Madrid, c/ Doctor Fourquet nº 3, mediante la extracción aleatoria de 2 ganadores, utilizando un sistema informático que funciona totalmente al azar. 

CLÁUSULA 5.- ENTREGA DEL PREMIO. 
Los ganadores serán contactados a través del correo electrónico de 3INA Spain. 

En el caso de que no fuera posible localizar a los ganadores en un plazo de 5 días por correo electrónico para que acepten el premio, o bien, si rechazasen el premio expresamente, por cualquier causa, el Sorteo será declarado como desierto. 

Una vez aceptado el premio, cada ganador recibirá un mensaje por correo electrónico con las indicaciones de entrega. El premio se enviará por correo postal a la dirección seleccionada por cada ganador tras la resolución del sorteo. 

Al premio del presente sorteo, les serán de aplicación la Ley 35/2006 de 28 de noviembre del Impuesto sobre la Renta de las Personas Físicas y el Real Decreto 439/2007 de 30 de marzo, por el que se aprueba el Reglamento del Impuesto de la Renta de las Personas Físicas. 

CLÁUSULA 6. PROPIEDAD INTELECTUAL. 
El ganador autoriza a que su imagen y nombre de usuario en Instagram, sean publicados en la página web y redes sociales de 3INA, así como en cualquiera de los canales oficiales de comunicación de la marca, sin que ello genere derecho a su favor a recibir contraprestación alguna.

CLÁUSULA 7 -. ACEPTACION DE LAS BASES Y RESPONSABILIDAD. 

  1. El mero hecho de participar en el Sorteo implica la aceptación íntegra de las presentes Bases. 
  2. 3INA se reserva el derecho a modificar las Bases del Sorteo, parcial o totalmente en cualquier momento. Asimismo, se reserva también el derecho de anularlo o dejar el premio desierto en caso de detectarse alguna irregularidad. Realizada cualquier modificación, ésta será debidamente puesta en conocimiento de los participantes en la página Web de 3INA. 
  3. 3INA se reserva el derecho de excluir de la participación en el Sorteo a todos aquellos participantes que, estime, están incumpliendo cualquier condición de participación incluida en las presentes Bases. La exclusión de un participante, cualquiera que sea la causa, conlleva la pérdida de todos los derechos derivados de su condición como tal. 
  4. Cualquier utilización abusiva o fraudulenta de estas Bases dará lugar a la consiguiente descalificación del participante en el Sorteo. 
  5. 3INA queda eximido de cualquier responsabilidad en el supuesto de existir algún error en los datos facilitados en su caso por los propios agraciados que impidiera su identificación. 

CLÁUSULA 8 -. POLÍTICA DE PRIVACIDAD. 

Responsable: 3INA COSMETICS, SL, con domicilio a efectos de notificaciones en Madrid, 28012, c/ Doctor Fourquet nº 3. 
Finalidad: La finalidad principal del tratamiento de los datos personales es el mantenimiento, cumplimiento, desarrollo y gestión de este sorteo, el contacto con los ganadores y publicación de su nombre de usuario en la cuenta/perfil de 3INA en Instagram como ganadores del sorteo, así como la inclusión de su nombre e imagen en la página web y redes sociales de 3INA y en cualquiera de los canales oficiales de comunicación de la marca, comprobación del cumplimiento de las condiciones para ser participante y ganador; entrega de los premios;  y cumplimiento, en su caso, de las obligaciones fiscales. 
Legitimación: Tratamos los datos de carácter personal sobre la base del consentimiento al participar en el sorteo.  
Destinatarios: No se ceden datos a terceros, salvo obligación legal.  
Plazo de conservación de su información: la información se conservará únicamente hasta la finalización del sorteo y en su caso, en su caso, en cuanto al ganador, durante un plazo de 2 años a contar de la entrega del premio. 
Derechos: Puede ejercer los derechos de acceso, rectificación, supresión, limitación del tratamiento, portabilidad y oposición en los términos recogidos en el Reglamento General de Protección de Datos y en la Ley Orgánica de Protección de Datos de Carácter Personal. Para ello, envía un email a hello@3ina.com, o remite una carta a Dpto. de IT, Madrid, 28012, c/ Dr Fourquet nº 3.  

Cualquier reclamación sobre el tratamiento de sus datos deberá ser presentada ante la Agencia Española de Protección de Datos C/ Jorge Juan, 6, 28001 Madrid (www.agpd.es). 

CLÁUSULA 9. – LEY APLICABLE - CONTROVERSIA. 
Estas Bases están sujetas a la legislación española. Cualquier reclamación relacionada con el Sorteo debe enviarse por escrito a 3INA Cosmetics, SL, a la At. del Departamento de Marketing de 3INA, a la siguiente dirección: c/ Dr Fourquet nº 3, 28012, Madrid, antes de los treinta (30) días posteriores a la fecha límite de participación en el Sorteo. En caso de controversia en la aplicación o interpretación de estas Bases y en ausencia de un acuerdo amistoso, todo litigio estará sujeto a los tribunales de la ciudad de Madrid.
