Giveaway Terms

CLAUSE 1 - ORGANISING COMPANY

3INA Cosmetics, SL, with registered office at c/ Doctor Fourquer nº 3Madrid, CIF B-87141305 and owner of the 3INA brand, organizes on the dates indicated below, a free giveaway with no obligation to purchase in accordance with the requirements described in these Terms and Conditions.

CLAUSE 2 – TERM OF PARTICIPATION

The term of participation is from Wednesday 13^th March 2024 to Wednesday 20^th March 2024, both inclusive.

CLAUSE 3 - CONDITIONS OF THE GIVEAWAY

Entrants must be a resident in the UK or Ireland. The selected winner must provide a verifiable residential address within the geographic boundaries of the United Kingdom and Ireland in order to claim the prize.

To participate you must be over 16 years of age at the time of entry, or to be represented or with the authorisation of the holder of parental authority or guardianship over the child.

Participants must not be an employee or immediate relative of any employees of 3INA Cosmetics or of any giveaway sponsors, prize providers, co-promoters or their group or affiliate companies or any other person professionally connected with the giveaway.

Winners of the giveaway are required to provide accurate and complete personal information when entering, which must include their full name, address, date of birth, and contact information. Failure to do so will result in the disqualification of your entry and the inability to send the prize to you.

CLAUSE 4 – METHOD OF ENTRY

The giveaway shall be conducted on platforms on which 3INA has a profile namely Instagram and TikTok. There will be two distinct draws, one for Instagram and another for TikTok, resulting in a total of two prizes. Participants are permitted to submit entries on both platforms.

It is possible for a participant to win twice, contingent upon the submission of a valid entry on both platforms as detailed below.

Participants only need to enter once to be entered into the draw, however, you may enter as many times as you wish.

For a comment to be considered part of a valid entry it must have a unique value and must tag a unique account. Tagging the same friend in multiple comments will count as one entry.

To submit a valid entry, strict adherence to the following steps is required:

4.1 INSTAGRAM ENTRY

• Like the Instagram giveaway social post posted on Wednesday 13^th March by @3INA. This will be clearly signposted as a giveaway in the caption.
•        Tag a friend in the comments of the same post.
•        Follow @3INA on Instagram.

4.2 TIKTOK ENTRY

• Like the TikTok giveaway social post posted on Wednesday 13^th March 2024 by @3INA. This will be clearly signposted as a giveaway in the caption.
•        Tag a friend in the comments of the same post.
•        Follow @3INA on TikTok.

By following these rules, you will automatically be entered into our giveaway.

CLAUSE 3.- PRIZE.

Two winners will be selected, with one recipient chosen from each platform (Instagram and TikTok), and each winner will be awarded one prize.  The prize will consist of 11 products (with a total value of £154):

CLAUSE 4.- DRAW.

The draws will take place on Wednesday 20^th March 2024 by means of the random drawing of one winner from each platform along with 4 other participants as reserves, using a computer system that works completely at random. 

CLAUSE 5.- PRIZE DELIVERY.

3INA Cosmetics will notify the giveaway winner via the platform that they entered on by private message. The winner’s social media profile will also be tagged publicly within the comment section where this has been the method of entry.

In the event that it is not possible to locate the winner within 2 days by private message to accept the prize, or if he/she expressly rejects the prize for any reason, the giveaway will be declared void.

Once the prize has been accepted, the winner will receive a message via Instagram with the prize delivery instructions. The prize will be sent to the address provided by the winner within a maximum period of 30 working days following the resolution of the giveaway.

Law 35/2006 of November 28th on Personal Income Tax and Royal Decree 439/2007 of March 30th, approving the Personal Income Tax Regulations shall be applicable to the prize of the present draw.

CLAUSE 6. INTELLECTUAL PROPERTY.

The winner authorizes his/her image and username to be published on 3INA's website and social networks, as well as in any of the brand's official communication channels, without this generating any right in his/her favor to receive any consideration whatsoever. 

CLAUSE 7 -. ACCEPTANCE OF THE TERMS AND CONDITIONS AND LIABILITY.

1.The mere fact of participating in the giveaway implies full acceptance of these Rules and that you respect and comply with Meta, TikTok and Instagram's terms and conditions.

2.It is expressly stated that Instagram, Meta, and TikTok do not sponsor, endorse, or administer the giveaway, nor is it associated with it.

3.3INA reserves the right to modify the Terms and Conditions of the giveaway, partially or totally at any time. Likewise, it also reserves the right to cancel it or leave the prize void in the event of any irregularity being detected. Once any modification has been made, it will be duly notified to the participants on the 3INA website.

4.3INA reserves the right to exclude from participation in the giveaway all participants who, in its opinion, are in breach of any of the conditions of participation included in these terms and conditions. The exclusion of a participant, for any reason whatsoever, entails the loss of all rights deriving from his/her status as such.

5.Any abusive or fraudulent use of these rules will result in the consequent disqualification of the participant in the Sweepstakes.

6.3INA is exempt from any liability in the event of any error in the data provided by the winners themselves that would prevent their identification.

CLAUSE 8 -. PRIVACY POLICY.

Responsible: 3INA COSMETICS S.L, with address for notification purposes in Madrid c/ Doctor Fourquet nº 3.

Purpose: The main purpose of the processing of personal data is the maintenance, compliance, development and management of this giveaway, contact with the winners and publication of their username in the 3INA account/profile on Instagram and/or TikTok as winners of the giveaway, as well as the inclusion of their name and image on the website and social networks of 3INA and in any of the official communication channels of the brand, verification of compliance with the conditions to be a participant and winner; delivery of the prizes; and compliance, where appropriate, with tax obligations.

Legitimation: We process personal data on the basis of consent to participate in the giveaway. 

Recipients: No data is transferred to third parties, unless legally required. 

Period of conservation of your information: the information will be kept only until the end of the giveaway and, where appropriate, delivery of the prize.

Rights: You can exercise your rights of access, rectification, deletion, limitation of processing, portability and opposition in the terms set forth in the General Data Protection Regulation and the Organic Law on the Protection of Personal Data. Any complaint about the processing of your data must be submitted to the Spanish Data Protection Agency C/ Jorge Juan, 6, 28001 Madrid (www.agpd.es).

CLAUSE 9. - APPLICABLE LAW - DISPUTE.

These Rules are subject to Spanish law. Any claim related to the giveaway must be sent in writing to 3INA Cosmetics, SL, to the Attn. of the Marketing Department of 3INA, at the following address: c/ Doctor Fourquet nº 3, Madrid, before thirty (30) days after the deadline for participation in the Giveaway. In case of dispute in the application or interpretation of these Rules and in the absence of an amicable agreement, any dispute shall be subject to the courts of the city of Madrid.
